Welcome to The Coparenting App. These Terms of Service govern your use of our platform and services. Please read them carefully before using the Platform.
By accessing or using The Coparenting App (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.
These Terms constitute a legally binding agreement between you and The Coparenting App. We encourage you to read them carefully before creating an account or using any features.
By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.
To use the Platform, you must create an account by providing accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
Each person should maintain only one account. You may not create an account on behalf of another individual without their explicit consent.
The Coparenting App provides a transactional SMS service for account verification codes and co-parent invite notifications. By opting in to receive text messages, you agree to the terms described in our SMS Messaging Terms at thecoparentingapp.com/sms-terms.
You consent to receive SMS by checking the messaging consent checkbox during signup. For invite messages, the inviting user must confirm they have the recipient’s permission before sending. All SMS is event-driven and user-initiated. We do not send promotional or marketing text messages.
Message frequency varies. Msg & data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance, or contact support@thecoparentingapp.com. Carriers are not liable for delayed or undelivered messages.
The Platform is designed to facilitate healthy, constructive co-parenting communication. You agree to use the Platform in good faith and in compliance with all applicable laws.
You may NOT use the Platform to: harass, threaten, or intimidate your co-parent or any other user; share or upload content that is illegal, abusive, defamatory, or sexually explicit; attempt to manipulate or tamper with messaging records; create false or misleading records for the purpose of deception in legal proceedings; share another user’s private information outside the Platform without their consent; or use automated systems, bots, or scrapers to access the Platform.
We reserve the right to review reported content and take action, including content removal, account suspension, or termination, if we determine a violation has occurred.
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, audio, software, and underlying code — are owned by or licensed to The Coparenting App and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of the content you create and upload to the Platform (messages, documents, photos, etc.). By uploading content, you grant us a limited license to store, process, and display that content as necessary to provide the service.
You may not copy, modify, distribute, sell, or lease any part of the Platform, nor may you reverse-engineer or attempt to extract the source code, unless permitted by applicable law.
The Coparenting App is a communication and organizational tool for co-parents. We are NOT a law firm, mediation service, or mental health provider. The Platform does not provide legal, financial, psychological, or parenting advice.
While we strive to keep the Platform available and functioning properly, we provide it on an “as is” and “as available” basis. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.
Any professionals listed in our directory are independent third parties. We do not endorse, verify credentials of, or assume liability for any professional listed on the Platform. You are responsible for conducting your own due diligence.
To the maximum extent permitted by applicable law, The Coparenting App and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
This includes, without limitation, damages for loss of data, loss of profits, business interruption, or any other commercial damages or losses, even if we have been advised of the possibility of such damages.
In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
You may terminate your account at any time by using the account deletion option in your settings or by contacting us at support@thecoparentingapp.com.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. In cases of serious violations (threats, harassment, evidence tampering), termination may be immediate and without prior notice.
Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or as necessary for legitimate business purposes, such as preserving court-ready records. You may request a data export before deleting your account.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions.
Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
Nothing in these Terms shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and/or through a prominent notice on the Platform at least 30 days before the changes take effect.
Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the modified Terms, you should discontinue use of the Platform and delete your account.
